A Makurdi High Court, presided over by Justice T. A. Kume, has nullified the seven-man caretaker committee of the Benue State All Progressives Congress (APC) . The decision follows a suit filed by the state chairman of the APC, Comrade Austin Agada, challenging the dissolution of the State Working Committee (SWC) by the National Working Committee (NWC).
According to Justice Kume, the dissolution of the EXCO was not in accordance with the party’s constitution and violated Agada’s right to fair hearing. He emphasized the importance of fair hearing, citing the example of God asking questions before taking action against Adam in the Garden of Eden.
The court ruled that all actions taken by the caretaker committee, appointed by the national secretariat of the APC, are null and void. This decision has significant implications for the APC in Benue State, as it effectively renders the caretaker committee’s actions invalid.
The APC has expressed concerns over the judgement, describing it as “appalling” and “legally unjustified.” The party has instructed its legal team to appeal the judgement and seek a stay of execution.
In the meantime, the APC has called on its members to remain calm and law-abiding, assuring them that the party will work within the law to exercise its constitutional rights of appeal.
